I&#039;m not an expert on disability law, but I&#039;m fairly certain she can.  And, I think federal civil rights (not ADA) laws are the ones supporting your position.  However, you&#039;ll probably have to jump through a myriad of hoops with the school administration.  The school may be able to legally jettison your request if the animal becomes disruptive and/or a classmate has animal-related allergies.

If/when the school begins to try your patience, you might want to tell them that failure to make reasonable accommodation for disabled kids could result in a total withdrawal of federal funding.  This tends to get the attention of most government-related bodies.

You will probably have to supply the school with documentation of your daughter&#039;s disability coupled with written support from your doctor that the animal in the classroom is medically necessary.  Your request for reasonable accommodation must be in writing.  The school gets time to respond.  If they can come up with some undue hardship or burden excuse, you may be out of luck.

Hopefully, the idea of having a child who is more able to focus during class will outweigh potential objections.  I&#039;m also thinking that perhaps the school isn&#039;t doing due diligence in terms of protecting your daughter from abuse.  Many states have laws on the books protecting your daughter from bullies.  Penalties for crimes against disabled people also tend to be more severe.

IMHO, the school has the ethical and perhaps the legal duty to eliminate your daughter&#039;s triggers from the school environment.  Federal civil rights laws should give you the ammunition to make this happen even if they find a way to deny your request for reasonable accommodation.

Please feel free to leave another comment to let me know how this turns out and/or if you experience frustrations and challenges.  No mother of a child with disabilities IMHO should have extra challenges strewn in her path.
